Sudan: EU Presidency Declaration following ICC decision concerning the arrest warrant for President Al-Bashir

Sommaire: 4 March 2009, Brussels - The European Union has taken note of the decision of the International Criminal Court's Pre-Trial Chamber to issue an arrest warrant against Sudan's President Omar Hassan Al-Bashir in connection with alleged crimes against humanity and war crimes in Darfur.

The EU reiterates its full support and respect for the International Criminal Court and its key role in the promotion of international justice.

The situation in Darfur was - by the UN Security Council Resolution 1593 (2005) - referred to the ICC for investigation of alleged, serious violations of international humanitarian and human rights laws. The Security Council decided that the "Government of Sudan and all other parties to the conflict in Darfur shall cooperate fully and provide any necessary assistance to the Court and the prosecutor".

As has been repeatedly done in the past, including in the Council Meeting on 16 June 2008, the EU urges the government of Sudan and all other parties to the conflict to cooperate fully with the ICC in order to comply with its obligations under international law and to combat impunity in Darfur.

The EU in this context also recalls the declaration of 31 March 2008 of the EU Presidency on behalf of the EU on the Anniversary of the referral of the situation in Darfur/Sudan to the ICC, as well as the declaration of 24 November 2008 of the EU Presidency on behalf of the EU on the ICC Prosecutor's request for arrest warrants for rebel group members allegedly responsible for the fatal attack on the African Union soldiers at Haskanita on 29 September 2007.

The EU urges the Government of Sudan and the Darfur rebel movements to show restraint in the current situation, to commit themselves to an immediate cessation of hostilities, to facilitate the continued deployment and the full implementation of the mandate of UNAMID as well as the efforts of the humanitarian organisations, vital for the survival of millions of civilians in Darfur, and to promote regional stability including through continued normalisation of relations between Sudan and Chad.

The EU reminds all parties to the conflict of their obligation to protect the civilian population and to respect their human rights as well as the general principles of humanitarian law.

The EU reaffirms its continued commitment and engagement towards the people of Sudan and calls on all parties to enhance the efforts in seeking a durable political resolution to the conflict in Darfur under the mediation efforts led by the Joint African Union and United Nations Chief Mediator, Djibrill Bassolé, and facilitated by the Government of Qatar.

The EU welcomes the "Agreement of Good Will and Confidence Building" signed in Doha on 17 February 2009 between the Government of Sudan and the Justice and Equality Movement, and recalls its declaration on 20 February 2009 by the Presidency on behalf of the EU.

The EU reaffirms the fundamental importance of the implementation in good faith of the Comprehensive Peace Agreement and recalls in this context its declaration of 9 January 2009 on the fourth anniversary of the signature of the agreement.

The EU stands ready to continue working with relevant stakeholders, and through all appropriate means, contributing to peace, justice and stability in the whole of Sudan.
