EU Presidency Statement - Persons with disabilities

Sumario: August 7, 2002: Statement by Minister Counsellor Marianne Løwenhaupt Hoffmann, Ministry of Foreign Affairs, on behalf of the European Union: Considerations regarding a monitoring mechanism in relation to a legally binding instrument on disability rights (New York)

Mr. Chairman,

I have the honour to speak on behalf of the European Union on the most appropriate monitoring mechanism in relation to a legally binding instrument on rights of persons with disabilities.

The European Union would like to recall its view that any legally binding instrument on the rights of persons with disabilities should be effective, enforceable and realistic.

As with all human rights treaties the responsibility for meeting the obligations created by any new thematic legally binding instrument will continue to remain with the States Parties.

It follows that any monitoring mechanism attached to any new thematic legally binding instrument on the rights of persons with disabilities should primarily aim at assisting States Parties in raising levels of understanding of the relevant obligations, to assist in the transfer of good practice and to play a useful role in ensuring effective implementation.

The European Union welcomes the work carried out with a view to rationalizing and streamlining the human rights machinery in order to avoid duplication and to promote efficiency and effectiveness in accordance with General Assembly Resolution 55/90.

The European Union would like to stress the importance of taking into account this important work when considerations regarding a monitoring mechanism to a legally binding instrument on rights of persons with disabilities are made in the Ad Hoc Committee. Nevertheless, the European Union would consider it important that some form of appropriate mechanism be developed under any new thematic legally binding instrument on the rights of persons with disabilities.

The European Union regards nominating persons with disabilities to a relevant monitoring mechanism to be of utmost importance, taking into account usual UN practice of having experts of high moral standing and recognized competence in the field.

With respect to the exact tasks of any monitoring mechanism the European Union would like to reserve its position pending further and more detailed considerations and consultations.
