The third meeting of the Accession Conference with Croatia at deputy level was held today in Brussels, following the start of accession negotiations on 3 October 2005. The aim was to open negotiations on chapter 7 - Intellectual Property Law.

For this chapter, and on the basis of negotiating positions, the Union has closely examined Croatia's general state of preparedness in this area. Taking into account Croatia's present state of preparations - and on the understanding that Croatia will continue to make progress in the alignment with and implementation of the acquis - the EU notes that in order for the chapter to be provisionally closed the following two benchmarks need to be met:

- Complete the alignment with the Community acquis concerning the community exhaustion of rights and the introduction of supplementary protection certificates. Ensure that these rights will be enforced by accession.

- Ensure a sufficient administrative capacity to enforce the rights concerning the fight against piracy and counterfeit; provide a satisfactory track record of investigation, prosecutions, and judicial treatment of violations.
In more general terms, Croatia also needs to devote particular attention to the specific issues highlighted in the EU position with a view to ensuring sufficient administrative capacity to enforce the acquis in this chapter, as well as the completion of the legislative alignment concerning the exhaustion of rights, the Community IP titles, supplementary protection certificates and compulsory licensing for pharmaceuticals. The EU also underlines the importance of issues related to pharmaceutical and plant protection products that are protected and/or authorised in the EU at the date of Croatia's accession, as well as to measures ensuring the unitary character of the Community Trademark and of the Community Design.

The Union will closely monitor Croatia's progress in the alignment with and the implementation of the acquis in this chapter throughout the negotiations.
